1. About FlexiFleet

FlexiFleet Technologies Inc. (“FlexiFleet,” “we,” “us,” or “our”) operates a peer-to-peer vehicle sharing marketplace platform (the “Platform”) that connects vehicle owners (“Hosts”) with drivers seeking to rent those vehicles (“Renters”). FlexiFleet is incorporated in Saskatchewan, Canada, and currently operates in an approved pilot program in the cities of Regina and Saskatoon.

FlexiFleet is not an insurance company, a motor carrier, or a rental car company. We provide the technology platform to facilitate transactions between Hosts and Renters. All insurance coverage is provided through Saskatchewan Government Insurance (“SGI”) and applicable policies governed by The Saskatchewan Insurance Act.

2. Acceptance of Terms

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional policies referenced herein. If you do not agree, do not use the Platform. These terms constitute a binding legal agreement between you and FlexiFleet.

You must be at least 18 years of age to create an account. To rent a vehicle, you must be at least 21 years of age and hold a valid, unrestricted driver's licence recognised in Saskatchewan. To list a vehicle, you must be the registered owner or an authorised agent of the registered owner.

3. Platform Services

FlexiFleet provides the following services through the Platform:

  • Vehicle listing and search functionality
  • Booking and reservation management
  • Payment processing through our third-party payment provider (Stripe)
  • Pre-trip and post-trip vehicle inspection tools
  • Dispute resolution assistance
  • Driver identity verification
  • Compliance monitoring and reporting

4. User Accounts and Eligibility

Registration. You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Identity Verification.All users are required to complete identity verification before making or accepting bookings. FlexiFleet uses a third-party identity verification provider. Renters must provide a valid government-issued photo ID and a valid driver's licence.

Pilot Eligibility. During the Saskatchewan pilot phase, host registration is by invitation only. Hosts must receive and redeem a valid pilot invite code issued by FlexiFleet. Renters may register without an invite code unless otherwise specified.

Ineligibility.You are not eligible to use the Platform if: (a) you are under the applicable minimum age; (b) your driver's licence is suspended, revoked, or expired; (c) you have been banned from the Platform; or (d) you are prohibited by applicable law from using the Platform.

5. Booking and Payment

Booking Process.When a Renter submits a booking request, the Host has 24 hours to accept or decline. Bookings not responded to within 24 hours are automatically declined. Upon Host acceptance, the Renter's payment method is charged.

Pricing. All prices are displayed in Canadian dollars (CAD) inclusive of applicable taxes (Saskatchewan GST + PST = 11%). The Platform fee is 12% of the booking subtotal. Hosts receive 80% of the booking subtotal after the platform fee.

Security Deposit.A security deposit may be held at the Host's discretion. Deposits are released within 7 business days of trip completion, subject to damage claims.

Payment Processing.Payments are processed by Stripe. By making or receiving payments through the Platform, you agree to Stripe's Terms of Service and Privacy Policy. FlexiFleet does not store complete credit card information.

6. Vehicle Inspections

Pre-trip and post-trip inspections are mandatory for every booking. Both the Host and Renter are required to complete their respective inspection steps, including:

  • Recording vehicle condition (fuel level, odometer, damage notes)
  • Uploading condition photographs
  • Providing a digital signature attesting to the vehicle's condition

Inspection records are stored and may be used as evidence in disputes or SGI insurance claims. Failure to complete required inspections may void insurance coverage and result in account suspension.

7. Insurance and Liability

SGI Coverage.Vehicle rentals facilitated through the Platform are subject to SGI insurance requirements under The Saskatchewan Insurance Act. During the pilot phase, coverage is provided through SGI's approved programs applicable to peer-to-peer vehicle sharing.

Host Obligations. Hosts represent that their vehicle is validly registered, insured, and holds a current SGI safety certificate. Hosts must maintain their own personal vehicle insurance and must disclose their participation in the FlexiFleet platform to their insurer where required.

Renter Liability. Renters are responsible for any damage, traffic violations, tolls, or other liabilities incurred during their rental period. Renters must return the vehicle in the same condition as received.

Limitation of Liability.To the maximum extent permitted by Saskatchewan law, FlexiFleet's aggregate liability shall not exceed the greater of (a) the total platform fees paid by you in the 12 months preceding the claim, or (b) $500 CAD. FlexiFleet is not liable for indirect, special, or consequential damages.

8. Prohibited Conduct

You may not use the Platform to:

  • List vehicles you do not own or are not authorised to list
  • Provide false or misleading information about a vehicle or your identity
  • Circumvent the Platform's payment system
  • Use a rented vehicle for commercial purposes (e.g., ridesharing, delivery) without Host consent
  • Sublease or transfer a booking to another driver without prior written approval
  • Drive under the influence of alcohol or controlled substances
  • Use the vehicle outside of Saskatchewan without advance written approval from the Host
  • Harass, threaten, or discriminate against other users
  • Violate any applicable law, regulation, or ordinance

Violation of these prohibitions may result in immediate account suspension, forfeiture of payments, and referral to law enforcement where appropriate.

9. Reviews and Ratings

Both Hosts and Renters may submit reviews after a completed trip. Reviews must be honest, accurate, and not defamatory. FlexiFleet reserves the right to remove reviews that violate our Community Guidelines. Reviews form part of each user's Trust Score, which is used to determine eligibility for certain features and priority in search results.

10. Dispute Resolution

FlexiFleet provides a dispute resolution process for disagreements between Hosts and Renters. Disputes must be raised within 48 hours of trip completion. FlexiFleet's resolution decisions are final but do not preclude recourse through SGI or the courts.

Governing Law. These Terms are governed by the laws of the Province of Saskatchewan and the applicable laws of Canada. Any disputes not resolved through our internal process shall be submitted to the courts of Saskatchewan.

11. Modifications to Terms

FlexiFleet may modify these Terms at any time by posting updated Terms on the Platform and notifying registered users by email. Continued use of the Platform after the effective date of the modified Terms constitutes acceptance of the changes.

12. Termination

FlexiFleet may suspend or terminate your account at any time, with or without cause, with or without notice. You may terminate your account by contacting us at support@flexifleet.ca. Upon termination, all accrued rights and obligations survive.
